Swissmedlaw™ is the leading project of the renowned lawyer and entrepreneur Roland U. Straub, which specialises in tailor-made legal services and coaching offers. It was launched in response to the growing importance of medical and healthcare law in the everyday lives of the Swiss population. Roland Straub founded the sole proprietorship Swissmedlaw™ in Zurich in 2021 and has been offering first-class advice and services in the field of health and medical law ever since.

Swissmedlaw™ not only covers the traditional areas of civil, commercial and contract law, but also offers in-depth advice and coaching on topics such as patient rights, the electronic patient dossier (EPD), health insurance and social security law, medical and hospital liability and the legal aspects of the federal eHealth initiative. The preparation and mediation of data protection opinions and medical party opinions are also among the core competences.

The protection of personal rights and the right to informational self-determination are at the centre of all of Swissmedlaw™'s activities. The organisation supports the necessary cultural change by providing guidance and support to private individuals and organisations in order to use the achievements and innovations of digitalisation in the healthcare sector in a patient-friendly manner while maintaining comprehensive data protection.

Persönlichkeits- Und Datenschutz Im Alltag, Der Medizin Und Pflege

Im Rahmen des Gesetzgebungsverfahrens zum Elektronischen Patienten Dossier (EPD) wurde bewusst darauf verzichtet, die allgemeinen Bearbeitungsgrundsätze des Datenschutzes im Gesetz über das elektronische Patientendossier (EPDG) zu wiederholen. Stattdessen gelten für das EPD die Datenschutzgesetze des Bundes und der Kantone. Es ist jedoch wichtig zu beachten, dass gewisse Datenschutzregelungen im EPDG mit einigen der Grundsätze des DSG und der kantonalen Regelungen in Konflikt stehen können, insbesondere der Grundsatz der Zweckbindung (Art. 4 Abs. 3 DSG).

Patientenrecht

Die individuelle Dimension der Patientenrechte umfasst eine Vielzahl subjektiver Rechte, die eine Patientin oder ein Patient bei Bedarf mittels gerichtlicher Schritte geltend machen kann. Dazu gehören insbesondere das Recht auf medizinische Behandlung, das Recht auf freie Arzt- und Klinikauswahl (freie Spitalwahl), das Recht auf Information und die Entscheidung, eine Behandlung anzunehmen oder abzulehnen, das Recht auf Zugang zu medizinischen Aufzeichnungen, Krankenhaus- und Pflegedokumenten, das Recht auf Schutz der Privatsphäre und der persönlichen medizinischen Daten.
